"Best interests of the children" should be standard for allowing divorce


I still believe that no-fault divorce helps reduce
the level of conflict. Our society will never return to a fault-based
standard for divorce. That's fine by me.

I just think that before parents are granted a divorce, they should have to
prove that their divorce will be in the best interests of the children. They
should have to prove:

(1) that the intact household is harmful to the children,
(2) that a plan for parenting and supporting the children has been prepared
which provides for improved conditions for the children following the divorce,
(3) that the process of separating and divorcing will be conducted in a
manner that minimizes the disruption of the children's lives.

Now, there are many people who believe that if one of the parents is
dissatisfied in the marriage, then the environment is unhealthy for the
children. Those who hold this belief need to show the rest of us that public
policy for families should be based on that assumption.
