A. From Non-binding marriage
- separation for 6 months
- adultery
- spouse has committed felony and has been sentenced to death or imprisonment
at hard labor
Code: C.C. 103, as am'd Act 918 of 1991
B. From covenant marriage
- separation without reconciliation for a period of two years
- separation without reconciliation for a period of one year (one year and
a half if there is a minor child of that marriage) from the date the judgment
of separation from bed and board was signed.
Grounds for separation from bed and board:
(1) adultery
(2) one spouse has committed a felony and has been sentenced to death or
imprisonment at hard labor
(3) abandonment the matrimonial domicile for a period of one year
(4) physical or sexual abuse of spouse or child
(5) separation for a period of two years
(6) severe cruelty and habitual intemperance
- adultery
- spouse has committed felony and has been sentenced to death or imprisonment
at hard labor
- abandonment of matrimonial domicile for one year and constant refusal
to return
- severe cruelty and habitual intemperance
- physical or sexual abuse of the spouse or a child of the spouse
