In the name of God. I Abagail Swain of the County of
Tyrrel & State of N. Carolina being of sound desposing mind do made &
ordain this to be my last Will & Testament in the manner & form
following- After my death my boddy decently buried my burial expences paid &
one set of toom stones setting forth one at my head & the other to my foot
with my age & death also one set of tooms to my dear beloved father also one
set of tooms to my mother, also one set of tooms to my ?????? Also one set of
tooms to my sister Nancy Basnight setting forth to be there ages & death on
them tooms- One negro boy Tom to be sold at three months, six months
& nine months credit-
1st- I give and bequeath to my sister Polly one dollar-
2nd- I give & bequeath unto my brother Timothy $40- also I give to
his daughter Frances $10-
3rd- I give unto my brother Uriah Decd. His daughter M.
Elizabeth $16. I give to David T. $16- I give to Abagail
Frances $25.
4th- I give & bequeath to my sister Feribie one bed &
furniture.
5th- I give & bequeth to my sister Martha one chest- after my
onest debts is settled the balance of my money & notes to be equally divided
between my two youngest sisters Martha & Feribie- and lastly I
do hereby constitute and appoint my friend Timothy Swain & I. W.
Hassell my lawful executors to all intents & purposes to execute this my
last Will & Testament according to the true intent & meaning of the same
and every part & clause thereof hereby revoking & declairing utterly
void all other Wills & Testament by me heretofore made in Witness whereof I
the said Abagial Swain do hereunto set my hand & seal this the 29th
day of October A. D. 1848 signed sealed published & declaired by the said
Abagail Swain to be her last Will & Testament in the presence us who
at her request & in her presence do subscribe our names as witness thereto.

N. Carolina Tyrrel County Then was this paper writing exhibited in open court purporting to be the last
Will & Testament of Abagail Swain decd by Timothy Swain &
proved by the oath of Jacob Swain a subscribing witness thereto who swore
that he saw said Abagail Swain sign seal & deliver said writing to be
& contain her last will & testament, that at the time thereof she was of
sound & disposing mind & memory & that she did it freely & of
her own accord whereupon Timothy Swain qualified as executor thereto
ordered that the said paper writing with this probate be recorded.
