Dated 12 March 1759
In the name of God amen: The twelfth day of March one tousand seven hundred and fifty nine I John Spruill of Scupernong in the County of Tyrrel in North Carolina being in perfect helth thanks be to God therefore calling to remembrance the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament that is to say principally and first of all I give and recommend my soul into the hands of God and my body I recommend to the Earth to be buried in a decent Christain buriel at the duretion of my Executors nothing doubting but at the General Ressurection I shall receive the same again by the mighty power of God and as touching such worldly Extate where with it hath pleased God to bless me in this life I give demise and dispose of the same in the following manner and form.
Imprimis - I give to my well beloved son John Spruill one negro man called Mingo to him and his heirs forever.
Item - I give to my well beloved wife Mary Spruill the use and occupation of my whole Estate during her widdowhood and when my children comes of age to make an equall division in the Estate and let them when they come of age have their part according to the durection of my Executors and in case the negro waman named Patience should have any cahildren let my three daughters Elizabeth Spruill Memima Spruill and Debrah Spruill to have each of them one of the increase if any and the other part of the said negro woman to my two sons John Spruill and Evan Spruill and in case the aforesaid negro woman hath no children then I give her to my son Evan Spuill to him and his heirs forever I also appoint my well beloved wife Mary Spruill my Executrix and with her my two brothers Joseph Spruill and James Long my Executors of this my last Will and Testament and I do hereby utterly disallow revoak and disannul all and every other Testament Wills Legacies and Bequests and Executors by me any ways before named Willed and Bequeathed ratifying and confirming this and no other to be my last Will and Testament In witness whereof I have hereunto set my hand and seal the day and year first above written.
